In this Decision, the Telecommunications Commission (the “Commission”) establishes a New or Second Price Cap Regime (the “Second Regime”) to govern the tariff changes of regulated services provided by for Cable & Wireless (Turks & Caicos Islands) Limited (“C&W” or “LIME”). The Second Regime becomes effective on April 1, 2009 and will remain in effect for a four year period ending March 31, 2013. The rationale underlying and the specific details and of the Second Regime are set out in this Decision. A summary of the key elements of the Second Regime are provided below. Much like the existing price caps regime, which came into effect in January 2005, the Commission has implemented a simplified price cap regime for C&W in view of the relative scale of C&W’s operations in the Turks & Caicos Islands (“TCI”) relative to other international jurisdictions.
